HERDUM PRIVACY POLICY

Respect for your privacy is coded into our DNA - we’ve aspired to build our Services with a set of strong privacy principles in mind.

Herdum provides security and other services to users through a mobile application (“App”). When you use the App, some personal information is collected from and about you. Our Privacy Policy helps explain our information practices. For example, we explain what information we collect and how this affects you. We also explain the steps we take to protect your privacy – like building the security Services in such a manner that we do not store Customer’s location in the normal course, until the point of time when a Customer triggers an SOS using the App. We store location information only of Responders registered with us. We give you control over who you communicate with on our Services.

Herdum Systems Private Limited, is a company registered under the laws of India (“Herdum”). When we say “Herdum”, “we”, “our” or “us” refers to the aforesaid company or of it’s appointed Distributor servicing a geographical area. “You” or “your” refers to the user or customer (“Customer”), or “first responder” or “Angel” (“Responder”) accessing our Services including all associated features and functionalities, websites and user interfaces, content and software applications associated with those Services (“Services”).

This Privacy Policy (“Privacy Policy”) applies to all of our Apps, services, features, software, and website (together, “Services”) unless specified otherwise.

Please also read IRA Herdum’s End User License Agreement and Angel License Agreement, which describes the terms under which you use our Services (“Terms”). At registration you accepted the terms of this Privacy Policy and your use of the App signifies your continued acceptance thereof. This Privacy Policy may be revised from time to time and you will be notified of all such changes. In order to use the App, you will be required to consent to the terms of the Privacy Policy as revised from time to time.

Information We Collect

Herdum receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.

A.Information You Provide

Your Account Information. To create a Herdum account, you provide your name, address, mobile phone number, security services provider (if any), mobile phone numbers of your family/friends and emergency contacts who you wish us to communicate your distress message and your location when you trigger an SOS alarm using the App or a synced Herdum authorized wearable device (“SOS Incident”), the PIN to disable the SOS, the types of Responder you would want us to notify upon your SOS. If you use a Herdum wearable device, you provide your voice pass-phrase to trigger the SOS Incident. You provide us the phone numbers in your mobile address book on a regular basis, including those of both the users of our Services and your other contacts. You confirm you are authorized to provide us such numbers. You may also add other information to your account, such as a profile name, profile picture, status message, whether you want the local SOS alarm to be on deterrent or stealth mode, and your affiliation to a third party security services provider (“SSP”), if applicable to your subscription plan. As a Customer in the event you trigger an SOS ie as a person needing assistance (“PNA”), you confirm that your personal information and location can be displayed to Responders, that you can be tracked until you have cancelled the SOS Incident (or a maximum of 24 hours), and that your location can be displayed to Responders, SSPs, and the police so that they can efficiently come to your assistance.

Additional Account Information for Responders. If you opt also to register as a Responder to SOS Incidents, you provide us with your government provided UID, full current address, alternate contact numbers, photograph, email id, your acceptance for us to validate your personal particulars with your country’s national database. You may also add other information to your account, such as your preferred locations for providing SOS assistance. You agree that if you are an employee of our SSP, then your employer will provide part or all of this information to us on your behalf.

3Your Connections. To help flow of information during your SOS situation, we may create a group, chat or video based, comprising your emergency contacts, the responders who have agreed to help you, and yourself, and such groups and lists get associated with your account information.

4Customer Support. You may provide us with information related to your use of our Services, including copies of your messages, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to our App performance or other issues.

B.Automatically Collected Information

1 No Tracking of Customer. If you are a Customer, your location is not recorded or tracked by us. After you trigger an SOS, we retain on our servers a log of your locations until you have disabled the SOS (or a maximum of 24 hours), the mode of triggering the SOS, the autonomously activated voice and video recording, the chats between your emergency contacts, Responders and yourself.

2 Angel Tracking. If you are registered with us as a Responder, whether as a volunteer (“Angel”) or contracted by a Herdum registered SSP or you are a Herdum registered GIG worker, or as a member of a police service or a community police organisation, we retain on our servers a log of your location at all times. This is done so that we can locate you in the fastest possible time after a Customer triggers an SOS Incident, and so that this data can assist in preventing a crime or with crime investigation.

3Usage and Log Information. We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how you interact with others using our Services, and the like), log files, and diagnostic, crash, website, and performance logs and reports.

4Transactional Information. If you pay for our Services, we may receive information and confirmations, such as payment receipts, including from app stores or other third parties processing your payment.

5 Device and Connection Information. We collect device-specific information when you install, access, or use our Services. This includes information such as mobile handset model, operating system information, browser information, IP address, mobile network information including phone number, and device identifiers. We collect device location information after you trigger an SOS Incident, or if you are also registered as a Responder, or when you view locations nearby or those others have shared with you, and the like, and for diagnostics and troubleshooting purposes such as if you are having trouble with our App’s location features.

6Cookies. We use cookies to operate and to provide our Services. For example, we use cookies:

  • a to provide Herdum for desktop and other web-based services, improve your experiences, understand how our Services are being used, and customize our Services.
  • b We may also use cookies to understand which of our FAQs are most popular and to show you relevant content related to our Services.
  • c To remember your choices, such as your language preferences, and otherwise to customize our Services for you.

7How to Control Cookies. You can follow the instructions provided by your browser or device (usually located under "Settings" or "Preferences") to modify your cookie settings. Please note that if you set your browser or device to disable cookies, certain of our Services may not function properly.

8Status Information. We collect information about your online and status message changes on our Services, such as whether you are online (your “online status”), and when you last used our Services (your “last seen status”).

C.Third-Party Information

1Information Others Provide About You. We receive information other people provide us, which may include information about you. For example, when other users you know use our Services, they may provide your phone number from their mobile address book (just as you may provide theirs) to give a reference or avail of an offer or specify as an emergency contact.

2 Third-Party Providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with security services companies to market and distribute our Apps, and to utilize their guards as Responders for our Customers; we work with distributors to locally deliver Services to you; we work with partners to provide our infrastructure, delivery, and other systems, supply map and places information, process payments, help us understand how people use our Services, or market our Services. These providers may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and fix service issues.

D.How We Use Information

We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.

1.Your Mobile Number. The mobile number that you provide at the time of registration may be used to communicate with you through SMS, IVR, push notifications or other such means to communicate an SOS situation of a User, and to market our products and services.

2. Our Services. We operate and provide our Services, including providing customer support, and improving, fixing, and customizing our Services. We understand how people use our Services, and analyze and use the information we have to evaluate and improve our Services, research, develop, and test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We use cookies to operate, provide, improve, understand, and customize our Services.

3. Safety and Security. We verify accounts and activity, and promote safety and security on and about our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.

4. Communications About Our Services. We communicate with you about our Services and features and let you know about our terms and policies and other important updates. We may provide you marketing info on our Services.

5.Third-Party Banner Ads. We allow third-party banner advertisements on our App or on the Herdum website www.iraherdum.com

6.Commercial Messaging. We will allow you and third parties, like businesses, to communicate with each other using Herdum. You may receive messages containing marketing material that could include an offer for something that might interest you.

E.Retention.

1.Account Information. All information provided at the time of registration will be retained for as long as your account remains in existence and for such period thereafter as required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force.

2. PNA Location Information. As a PNA, your location information will be retained for a period of six (6) weeks after which such information shall be purged from the App and our servers.

3.Responder Location Information. As a Responder to a SOS Incident, your location information will be retained for a period of six (6) weeks after which such information shall be purged from the App and our servers.

4. Anonymized Datasets. Nothing set out herein shall apply to the anonymized, aggregated datasets generated by the personal data of registered users of the App or any reports, heat maps or other statistical visualizations created using such datasets.

Managing Your Information

If you would like to manage, change, limit, or delete your information, we allow you to do that through the following tools:

1.Services Settings. You can change your Services settings to manage certain information available to other users. You can manage your family and emergency contacts, groups, types of Responders that you want us to contact in case of SOS, and broadcast lists.

2. Changing Your Mobile Phone Number, Profile Name and Picture, and Status Message. You must change your mobile phone number using our in-app change number feature and transfer your account to your new mobile phone number. You can also change your profile name, profile picture, and status message at any time.

3. Deleting Your Herdum Account. You may delete your Herdum account at any time, including if you want to revoke your consent to our use of your information, by making use of our in-app Delete My Account feature. When you delete your Herdum account, your undelivered messages are deleted from our servers as well as any of your other information we no longer need to operate and provide our Services. Be mindful that if you only delete our Services from your device without using our in-app Delete My Account feature your information may be stored with us for a longer period. Please remember that when you delete your account, it does not affect the information other users have relating to you, such as their copy of the messages you sent them.

Law and Protection

We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users, Herdum, or others.

Updates to Our Policy

We may amend or update our Privacy Policy. We will provide you notice of amendments to this Privacy Policy, as appropriate, and update the “Last Modified” date at the top of this Privacy Policy. Your continued use of our Services confirms your acceptance of our Privacy Policy, as amended. If you do not agree to our Privacy Policy, as amended, you must stop using our Services. Please review our Privacy Policy from time to time

Data Security

The App is equipped with standard security features to protect the confidentiality and security of your information. Data is encrypted in transit as well as at rest. Personal information provided at the time of registration is encrypted before being uploaded to the cloud where it is stored in a secure encrypted server. Personal information that is stored in the Apps of other registered users is securely encrypted and are incapable of being accessed by such user. We will endeavour to use cloud servers that are either located in your country or are largely dedicated to your country for storing your personal data. We will endeavour to generate the data encryption keys that will used in the afore-said servers.
